So what are the types of land ownership in Ghana? Here are the five types of land ownership in Ghana:

  1. The stool/skin lands
  2. Family lands
  3. Individuals and corporate entities
  4. Public Lands
  5. Vested lands

Most people don’t know how to acquire land in Acca. People buy lands in Accra with no clue about the weak land tenure system they are signing to. I must say it can be a bit confusing due to the nature of the tenure system. Let me discuss each one of them in detail to help you make an informed decision before pulling the trigger on your land purchase.

1. The stool or skin lands

What are stool lands in Ghana?

Stool lands are in control or under the custody of the chiefs. Basically, it is placed in a Trust according to the customary law, controlled by the traditional rulers. By the way, in Ghana, we have stools and skins as these are attributed to the chiefs but to make matters simple “stool” is often used but applies to skins as well.

How were the stool lands acquired in Ghana?

Dated back in history, when the community moved and settled at various locations in the country.

Who can sell the stool lands in Ghana?

Obviously, the traditional ruler or the current chief, but with the consent or approval of the elders of the stool or skin. The chief or stool must also seek the consent of the traditional council, which includes all chiefs and sub-chiefs, before he can sell the land. If this is not adhered to, any land sale transaction is void. These lands are notorious for selling the same piece of land to several buyers, especially when the current chief is destooled, or stool dispute, or the chief passes on. 2. Family lands

What is family land ownership in Ghana?

As the name sounds, these lands are owned by the family and controlled by the head of the family. Only the head of the family can sell the land. I must caution you to be careful when buying family lands, as most family lands are characterized by family division and factions. Every faction’s head feels they can sell the land.

How do you go about buying family land?

The family head can sell the land but with the consent of the main or principal head of the family. Sounds complicated, isn’t it? Every family has someone as the head of the family, and then there is the overall family head.

In a situation where there are factions, the land must be sold by all the heads of the factions with the consent of the main head of principal if you will. Chances of double sale and dispute are inevitable. Now, do you understand why family disputes are one of the causes of land litigation?

3. State lands

What is state land ownership?

State lands simply mean government lands. These lands were acquired by the state and compensated the original owners. The governments use this land for development projects. Buying state is the most secure as the government keeps up-to-date records of the lands  – the purpose for acquisition, the compensations paid to the original owners, and under which law. The state lands account for 20% of the total lands in Ghana.

4. Vested lands

What is the meaning of vested lands?

These are lands the state has taken ownership from the customary landowners. These lands are in administered in the Trust for the landowning community. The vested lands account for 2% of the state with stool land, family lands in the form of ownership split.

How do you buy vested land in Ghana?

It doesn’t matter which region you are in, you need to submit the application to the executive secretary of Lands Commission or the regional director of Lands Commission.

5. Individuals and corporate entities

These are lands acquired by individuals or big corporations and property developers. These lands are somewhat secured as owners have done due diligence, went through all processes of land registration, and have the relevant documents needed.
