The causes of land litigation in Accra Ghana consist of so many factors not the least of which include: family disputes, improper documentation, incomplete documentation, unregistered lands, greed, lack of land transaction records, no demarcated boundaries, illiteracy, ignorance, poverty,  no due diligence, family divisions, dispute between the paramount chief and traditional council of elders, death, among others.

The bad news is, it is not getting better but worse and worst as more people acquire lands to build their homes. What is land dispute in Ghana?

A land dispute is simply a conflicting claim to rights to land by two or more parties who believe they are the rightful owners. In Ghana, this has been a norm. I bet one of your close relatives in Accra experienced land dispute. About 40% of people attended court hearing 21times and 60% of people attended 100times without any sign of case resolved. An acquintance of mine has been fighting land case in court for 40 good years. Yes, you heard me right.

 

If you are thinking of investing or buying real estate in Ghana, land is the baseline in your transaction. As a wise man once said “if you don’t own the land you own nothing.” According to Ghana law, land include the bare land you are buying and anything that you can’t take away with you – which include any structure you build on it. Unfortunately, land transaction is marred with disputes. Don’t take my word for it, the next lines will show the numbers.

 

Research by Accra High court registry shows that land litigation account for a mind-blowing 60,000 cases in Superior Courts in Accra and about 15000 cases pending. With minor courts, the results is immersed that they could not keep the data. Furthermore, about 59% of court cases in Ghana had something to do with land disputes. That said, there is about 25% in land case per year and the rate of settlement is only 10%. Read that line again, and land litigation cases in Ghana High Court hasn’t been factored. There are no official research data in recent years but this could triple. People spend money and time fighting legal battles to win land cases and this could drag on for  years like my acquiantance case.

My Final thought

Family, stool, clan and private ownership constitute about 78% to 80% of total land ownership in Ghana. Hitherto, there hasn’t been any aggressive land reforms. Land litigation problem should be treated as national problem. Should the right policies and reforms created, implemented and enforced we won’t be experiencing this madness in the court.
